本文件構成具法律約束力的協議（下稱「本協議」），訂立於您（下稱「您」或「客戶」）與 Dr SEN（下稱「Dr SEN」、「我們」或「我們的」）之間。Dr SEN 經營網址為 drsen.org 的網站（下稱「本網站」）。

本協議闡述您與我們雙方在以下方面的權利與責任：(a) 您對本網站及／或商店的存取；(b) 您對本網站及／或商店的使用；(c) 任何由 Dr SEN 發出的通訊；(d) 本網站及／或商店所包含的所有資訊、產品、服務及資料。

當您進入本網站及／或商店，即表示您無條件接受本協議提及的條款及細則（下稱「本條款」）（如下所列）以及我們日後可能作出的任何修改。

  • 本網站委託廠商協助蒐集、處理或利用您的個人資料時，將對委外廠商或個人善盡監督管理之責。

2f. Cookie 之使用

2g. 私隱權保護政策之修正

本網站私隱權保護政策將因應需求隨時進行修正，修正後的條款將刊登於本網站上。

  1. 退換政策

產品一經良好地運送到訂購者即為訂購者擁有，在任何情況下產品是不可退費的（包括運送問題），除非貨品是錯誤的。若需退換，請於收到錯誤貨品七天內透過 WhatsApp 告知本店您想要退換／交換的貨品及訂單號碼，我們收到資料後會盡快為您辦理相關程序。而您所退回的商品必須保持商品本體、附牛、內外包裝、配件、贈品、原廠包裝及所有隨附文件或資料的完整性，切勿缺漏任何配件或原廠外盒。如果起因是本店的錯誤，我們會付還運送費用。

補件

因各廠商各自負責他們自己的補件（注意：基本所有廠商都不會補回任何盒子、包裝或內托等非影響遊戲的物件）而不會經本店處理，如發生前述的補件問題可隨時聯繫他們索取。如果遇到任何問題，我們會嘗試進行協助。

其他注意事項

有很多原因會導致盒子、包裝或內托損壞／受壓／盒角壓縮等發生，如但不限於運輸、在進口流程中、甚至供應商的供應本身問題等等。基於這些均非本店所能控制，我們從供應商哪裡收到什麼就會發出什麼的。因此，本店不接受補回或退換或退款任何以盒子、包裝或內托受壓或受損或盒角壓縮等為由的產品退換要求，本店並不負責此部份責任（我們賣的或代購的是遊戲及相關產品，不是外包裝盒或外觀，非影響遊戲的物件）。若內容物有問題的話，請參看上方的「補件」就可。但您如須向運輸方面追討，本店則會予以協助。

  1. 免責聲明

4a. 本網站及／或商店包含的資訊僅供一般參考之用。該資訊由 Dr SEN 提供，雖然我們努力保持資訊更新和正確，但我們對本網站、商店、商品或本網站或商店包含的資訊、產品、服務或相關圖像的完整性、準確性、可靠性、適用性或可用性，不作任何明示或暗示的陳述或保證。因此，您對任何此類資訊的任何依賴完全由您自行承擔風險。

本協議將按照中華人民共和國香港特別行政區（下稱「香港」）的法律詮釋，並受香港法律的司法管轄。您同意任何源自或與本協議相關的索賠或訴訟均受香港的司法管轄。

All transactions conducted with our company are subject to the following details and terms, which represent your agreement to be bound by (i) these terms with yourself, and (ii) the legally binding contractual terms between you and Dr SEN. It also signifies your acceptance and agreement to all of the following transaction details and terms. Please be sure to thoroughly read all of the following terms before placing your order.

This document constitutes a legally binding agreement (this “Agreement”) between you (“you” or “customer(s)”) and Dr SEN (“Dr SEN”, “we” or “us”) which operates the website with the domain name, drsen.org (the “Site”).

This Agreement documents your rights and responsibilities and ours with regards to (a) your access to the Site and/or the Shop; (b) your use of the Site and/or the Shop; (c) any communications sent from Dr SEN; (d) all information, products, services, and materials contained on the Site and/or the Shop.

By entering the Site and/or the Shop you unconditionally accept the terms and conditions (the “Terms”) referred to in this Agreement (set out below) and any future alterations we may make subsequently.

If you do not accept the Terms, do not use the Site or the Shop. We may change the Terms from time to time and if we change the Terms, we will post the revised document here, so you should review them each time that you visit the Site and/or the Shop. You should print a copy of the Terms for future reference.

  1. USERS

1a.Anyone who enters the Site and/or the Shop is deemed a user. You are free to enter the Site and/or the Shop whenever you wish whilst adhering to all the relevant terms and conditions referred to in the Terms.

1b.The use of the Site and/or the Shop is permitted for personal use only. Please remember that it is illegal to re-publish, sell, reproduce or otherwise exploit any items on the Site or the Shop for material purposes from the Site or the Shop, or create any item based on the content of the Site or the Shop.

1c.You alone are absolutely responsible for any information sent to us and its accuracy and validity. You agree that you will not use and that you will not allow the use of any device or method that could possibly interfere with the Site and/or the Shop. You may access and view the content appearing on the Site and/or the Shop for personal, non-commercial use only.

1d.We are the owner or licensee of all intellectual property rights in the Site and the Shop and the material published on them. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Dr SEN (hereinafter referred to as “the Website”) is committed to protecting the privacy of its users. This Privacy Policy outlines how the Website collects, uses, and safeguards personal information. By accessing and using the Website, you consent to the terms of this Privacy Policy. Please read this policy carefully.

2a. Scope

This Privacy Policy applies solely to information collected by this Website. It does not apply to third-party websites linked to or from this Website, nor does it apply to individuals not employed by or directly contracted by Dr SEN.

2b. Collection, Processing, and Use of Personal Information

When you visit the Website or utilize its services, we may collect necessary personal information depending on the nature of the service. This information will be used solely for the specific purpose for which it was collected. We will not use your personal information for any other purpose without your explicit written consent.

Exceptions to this include, but are not limited to:

  • In cooperation with government agencies or academic institutions for statistical or academic research in the public interest, where data is processed in a manner that prevents identification of specific individuals.
  • When your behavior on the Website violates the Terms of Service, or may harm the rights and interests of the Website or other users, or cause damage to any person, and disclosure of your personal information is necessary for identification, contact, or legal action.
  • For the protection of your legitimate interests.
  • When the Website engages contractors to assist in the collection, processing, or use of your personal information, the Website will exercise due diligence in supervising and managing these contractors.

To provide optimal service, the Website may place and access cookies on your computer. If you prefer not to accept cookies, you can adjust your browser’s privacy settings to a high level to reject them. However, this may prevent certain website functions from operating correctly.

This Privacy Policy may be amended from time to time as necessary. Revised terms will be published on the Website.

 

  1. Return and Exchange Policy

Once a product has been successfully delivered to the customer, ownership of the product transfers to the customer. Under no circumstances are products refundable (including shipping issues) unless the item is incorrect. For returns or exchanges, please notify us via WhatsApp within seven days of receiving the incorrect item, stating the item you wish to return/exchange and your order number. Upon receiving this information, we will process the relevant procedures for you as soon as possible. The returned product must retain its original form, including tags, inner and outer packaging, accessories, gifts, original packaging, and all accompanying documents or materials. Please do not omit any accessories or the original outer box. If the return is due to an error on our part, we will reimburse the shipping costs.

Replacements

Each manufacturer is responsible for their own replacements (note: basically all manufacturers will not replace any boxes, packaging, or inner trays that do not affect the game) and will not be processed through our store. If the aforementioned replacement issue occurs, you can contact them at any time to request it. We will try our best to assist if you encounter any difficulties.

Other Important Notes

There are many reasons that can cause damage/pressure/compression of box corners, etc. to boxes, packaging, or inner trays, such as but not limited to transportation, during the import process, or even problems with the supplier’s supply itself. Since these are beyond our control, we will ship whatever we receive from the supplier. Therefore, our store does not accept requests to replace, exchange, or refund any products due to pressure or damage to the box, packaging, or inner tray, or compression of box corners, etc. We are not responsible for this part (what we sell or purchase on behalf of customers is the game and related products, not the outer packaging box or appearance, non-game-affecting items). If there is a problem with the contents, please refer to the “Replacements” section above. However, if you need to seek compensation from the shipping company, we will provide assistance.

4a.The information contained in the Site and/or the Shop is for general information purposes only. The information is provided by Dr SEN and while we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Site, the Shop, the Goods or the information, products, services, or related graphics contained on the Site or the Shop for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

4b.In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the Site and/or the Shop.

4c.Through the Site and/or the Shop you are able to link to other websites which are not under the control of Dr SEN. We have no control over the nature, content and availability of those websites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

4d.Every effort is made to keep the Site and/or the Shop up and running smoothly. However, Dr SEN takes no responsibility for, and will not be liable for, the Site or the Shop being temporarily unavailable due to technical issues beyond our control.

 

  1. GOVERNING LAW AND JURISDICTION

This Agreement will be interpreted in accordance with the laws of the Hong Kong Special Administrative Region, the People’s Republic of China (“Hong Kong”), and subject to the jurisdiction of the Hong Kong legislation. You agree that any claim or litigation derived from or related to this Agreement are subject to the jurisdiction of Hong Kong.
